TERMS OF USE

For your information, "SUPER GRAM" is a brand owned and operated by Urban Mills Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at DSM-352, DLF Commercial Tower, Shivaji Marg, Moti Nagar, New Delhi –110015 (hereinafter referred as "We"/"Super Gram"/"Us"/"Our").

The terms and conditions/terms of use ("Terms") governing Super Gram (defined later) and services (defined later) follow:

ACCEPTANCE OF TERMS

  • These terms are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the Super Gram's website ("Site") and/or related mobile or software applications including but not limited to the services offered by Super Gram or otherwise "Services".
  • Your use/access of the Site shall be governed by these Terms and the Privacy Policy of Super Gram as available at https://www.supergramofficial.com
  • These terms may be updated from time to time by Super Gram without notice. It is therefore strongly recommended that you review these Terms, as available on the Site of Super Gram, each time you access and/or use the Site of Super Gram. In the event there is any conflict or inconsistency between these Terms and any other terms of use that appear on the Site of Super Gram, these Terms will prevail.

SERVICES OVERVIEW

Super Gram is India's Snack Brand, manufactured and sold by Urban Mills Pvt. Ltd. Our products are manufactured and sold under FSSAI License No. 13324006000426.

ELIGIBILITY

  • The Site is intended for business and professional use by individuals who are at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. By using the Website, you represent that you meet this requirement. However, if you are a minor, i.e. under the age of 18 years, you may access the Site of Super Gram under the supervision of an adult parent or legal guardian "competent to contract" who agrees to be bound by these Terms.

SCOPE OF SERVICES

  • We sell packaged Snack and related snack products in various flavors and pack sizes, as listed on the Website from time to time.
  • Product images are for representation purposes only. Actual packaging, weight, or appearance may vary slightly.
  • Nutritional information, ingredients, and allergen details are provided on the product packaging and/or product pages. Please read these carefully before consumption, especially if you have food allergies or dietary restrictions.
  • We reserve the right to modify, discontinue, or update any product, recipe, packaging, or flavour at any time without prior notice.
  • All products are subject to availability. Items marked "Sold Out" are temporarily unavailable and may be restocked at our discretion.

PRICING AND PAYMENT

  • All prices listed on the Website are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise, with shipping calculated separately at checkout where applicable.
  • We reserve the right to change prices, discounts, and offers at any time without notice. Prices applicable at the time of order confirmation shall apply to that order.
  • Payments are processed through third-party, secure payment gateways integrated with our Shopify-powered store. We do not store your full card, UPI, or net-banking credentials.
  • In the event of a pricing error on the Website, we reserve the right to cancel any order placed based on the incorrect price and will notify you and issue a refund if payment was already made.

ORDER CONFIRMATION AND CANCELLATION

  • An order is confirmed only upon receipt of payment and a confirmation email/message from us. Receipt of an order does not constitute our acceptance of it.
  • We reserve the right to refuse or cancel any order due to product unavailability, errors in pricing or product information, suspected fraudulent activity, or other reasons at our discretion. If your order is cancelled after payment, a full refund will be issued to your original payment method.
  • You may request cancellation of an order before it has been shipped by contacting us via the Contact Us page or WhatsApp. Once an order is shipped, it cannot be cancelled.

SHIPPING AND DELIVERY

  • We aim to ship and deliver orders within the timelines communicated at checkout or via order confirmation, but these are estimates and not guaranteed delivery dates.
  • Delivery timelines may be affected by courier delays, weather, regional restrictions, incorrect/incomplete addresses, or other circumstances beyond our reasonable control.
  • Risk in the goods passes to you upon delivery to the address provided by you at checkout. Please ensure your shipping address and contact number are accurate.
  • We currently ship within India. Any changes to serviceable locations will be reflected at checkout.
  • In case of RTO (Return to Origin) due to an incorrect address, customer unavailability, or refusal to accept the order, the customer will be responsible for the applicable re-shipping charges.
  • Claims for damaged goods will only be accepted if reported within 24 hours of delivery with supporting photos.

RETURNS, REFUNDS, AND EXCHANGES

Because Super Gram products are consumable food items, and in line with applicable food-safety practice:

We do not accept returns or exchanges once a product has been delivered and the package has been opened, except in the following cases:

  • We delivered a damaged, defective, or tampered product.
  • We delivered the wrong product or flavour.
  • We delivered a product after its expiry or best-before date.

We require you to contact us within 24 hours of delivery through our Contact page or WhatsApp. We also require:

  • Your order number.
  • Clear photographs of the product, outer packaging, and batch code.
  • A continuous, unedited (raw) video with a visible timestamp showing the package being opened from start to finish.

Once we verify and approve your claim, we will either:

  • Replace the product at no extra cost, or
  • Refund the amount to your original payment method within a reasonable time.

We reserve the right to reject any claim if the required evidence is not provided or if the product appears to have been tampered with after delivery.

PROMOTIONS, DISCOUNTS, AND NEWSLETTER

  • From time to time, we may offer discount codes, promotional offers, or a sign-up discount (such as our newsletter offer) at our sole discretion. Such offers may be modified, withdrawn, or limited (e.g., one use per customer) at any time.
  • By subscribing to our newsletter or providing your email/phone number, you consent to receive marketing communications from us. You may unsubscribe at any time using the link provided in our emails or by contacting us directly.

INTELLECTUAL PROPERTY

All content on the Website including the Super Gram name, logo, product names, packaging design, graphics, text, images, and other materials is the property of Urban Mills Pvt. Ltd. or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or use any of this content for commercial purposes without our prior written consent.

USER CONDUCT

When using the Website, you agree not to:

  • Use the Website for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Website, other users' accounts, or our systems;
  • Upload or transmit any harmful code, malware, or disruptive content;
  • Post or submit any false, misleading, defamatory, or infringing content (including in product reviews or testimonials).

We reserve the right to remove any content and suspend or terminate access for users who violate these Terms.

THIRD-PARTY LINKS AND SERVICES

The Website may contain links to third-party websites or services (e.g., payment gateways, WhatsApp, social media platforms) that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party sites.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

  • Super Gram shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or products, including but not limited to allergic reactions arising from failure to review ingredient/allergen information, misuse or improper storage of the product, or delays caused by third-party couriers.
  • Our aggregate liability in connection with any order shall not exceed the amount actually paid by you for that order.

Nothing in these Terms limits any liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019, and the Food Safety and Standards Act, 2006.

ALLERGEN AND HEALTH DISCLAIMER

While our products are prepared with quality ingredients and food-safety practices, they are manufactured in a facility that may also process other allergens. Please check the ingredient list and allergen declarations on the packaging before consumption. Our products are not a substitute for medical or dietary advice; please consult a healthcare professional if you have specific health conditions, allergies, or dietary requirements.

GRIEVANCE REDRESSAL

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, any complaints or concerns regarding orders, products, or the Website may be directed to our Grievance Officer:

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts at New Delhi, India.

CHANGES TO THESE TERMS

We may update or revise these Terms from time to time to reflect changes in our practices, products, or applicable law. The updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Website after such changes constitutes your acceptance of the revised Terms.
